Eligibility - Referrer
An "eligible referrer" does not need to be a current Boomerang.com client. However, if the "eligible referrer" is a client, they must be in good financial standing with Boomerang.com to receive a gift under the Program.

Eligibility - Referred
"Eligible referred individuals" under the Program cannot be current or former Boomerang.com customers.

Referral Process
An "eligible referrer" identifies an "eligible referred individual" by completing and submitting the Referral Form located on the web site or in the body of the email. No other form of submission will be accepted. Eligibility is at the sole discretion of Boomerang.com.

Referral Gifts
Boomerang will mail the "eligible referrer" a $5 Starbucks Gift Certificate for each eligible referral submitted, up to a maximum of twenty (20) $5 Gift Certificates. "Eligible referred individuals" are companies that send an email, either purchased or as part of their 100 free emails that new accounts receive for testing. Eligibility is at the sole discretion of Boomerang.com.

When an "eligible referred individual" signs an annual contract with Boomerang for a minimum $500/month, the appropriate "eligible referrer" will receive a $250 American Express Gift Card. Only one (1) AMEX Gift Card will be provided for each "eligible referred individual". If the same person is referred by multiple parties, the first person to submit the Referral Form will be considered the "eligible referrer". Only one (1) AMEX Gift Card will be awarded for all new business an "eligible referrer" brings in.

Payment Process
$5 Starbucks Gift Certificates will be mailed within 5 business days of Boomerang.com's receiving an eligible referral. Gift Cards will be mailed within 20 business days of Boomerang.com's receiving an annual contract for a minimum $500/month from the "eligible referred individual."

Substitution
Boomerang.com reserves the right to substitute an item of comparable value. As an alternative, "eligible referrers" can choose to receive a $250 credit to their account in lieu of the AMEX Gift Card.

Right to Modify
Boomerang.com reserves the right to change or discontinue the Program at any time without notice.

Entire Agreement
These Rules and Regulations represent the entire agreement between Boomerang.com customers and Boomerang.com with respect to the Referral Program.

Governing Law
These Rules and Regulations will be interpreted, construed, and enforced in all respects in accordance with the laws of the State of California, without giving effect to any principles of conflicts of laws. You hereby irrevocably consent and submit to the exclusive personal jurisdiction of the state and federal courts within Santa Clara County, California for the purposes of litigating any such action.
